{"id":664,"date":"2025-09-03T08:11:00","date_gmt":"2025-09-03T06:11:00","guid":{"rendered":"https:\/\/moore-salzburg-gmbh.eu.moore-global.com\/?p=664"},"modified":"2025-12-16T14:06:31","modified_gmt":"2025-12-16T13:06:31","slug":"kuendigungsfrist-arbeiter","status":"publish","type":"post","link":"https:\/\/www.moore-salzburg.at\/tr\/kuendigungsfrist-arbeiter\/","title":{"rendered":"\u00c7al\u0131\u015fanlar i\u00e7in ihbar s\u00fcreleri"},"content":{"rendered":"<h3 class=\"wp-block-heading\">G\u00fcncelleme 03\/09\/2025<\/h3>\n\n\n\n<h4 class=\"wp-block-heading\">2026'dan itibaren i\u015f\u00e7ilerin ihbar s\u00fcreleri i\u00e7in yeni yasal d\u00fczenleme<\/h4>\n\n\n\n<p>Sosyal \u0130\u015fler Bakanl\u0131\u011f\u0131 taraf\u0131ndan haz\u0131rlanan taslak de\u011ferlendirmeye g\u00f6re, i\u015f\u00e7iler i\u00e7in yasal ihbar s\u00fcreleri ve son ba\u015fvuru tarihleri 1 Ocak 2026 tarihinden itibaren ge\u00e7erli olmak \u00fczere yeniden d\u00fczenlenecektir:<br><strong>A\u011f\u0131rl\u0131kl\u0131 olarak mevsimsel sekt\u00f6rlerde (\u201emevsimsel ayr\u0131cal\u0131k\u201c) toplu i\u015f s\u00f6zle\u015fmesi ortaklar\u0131na ihbar s\u00fcrelerini farkl\u0131 d\u00fczenleme konusunda yasal yetki verilmesi.\u201c <\/strong>ABGB'nin 1159. maddesinin 2. f\u0131kras\u0131n\u0131n son c\u00fcmlesi uyar\u0131nca<strong>) 1 Ocak 2026 tarihinden itibaren ge\u00e7erli olmak \u00fczere kanundan \u00e7\u0131kar\u0131lacakt\u0131r. <\/strong>Bunun arka plan\u0131nda, mevsimsel h\u00fckm\u00fcn yorumlanmas\u0131na ili\u015fkin iyi bilinen sorun yatmaktad\u0131r.<\/p>\n\n\n\n<p>ABGB'nin 1159. maddesinin 2. paragraf\u0131nda yap\u0131lmas\u0131 planlanan de\u011fi\u015fiklik, 2026 y\u0131l\u0131ndan itibaren i\u015fveren fesihleri i\u00e7in daha \u00f6nce oldu\u011fu gibi alt\u0131 haftal\u0131k bir ihbar s\u00fcresi ve hizmet y\u0131l\u0131na ba\u011fl\u0131 olarak be\u015f aya kadar bir art\u0131\u015f \u00f6ng\u00f6rmektedir (fesih tarihinin \u00fc\u00e7 ayl\u0131k d\u00f6nemin sonu veya takvim ay\u0131n\u0131n 15. ve\/veya son g\u00fcn\u00fc olarak kalmas\u0131 da kararla\u015ft\u0131r\u0131labilir).<\/p>\n\n\n\n<p>Yeni olan, toplu i\u015f s\u00f6zle\u015fmesi ortaklar\u0131n\u0131n mevsimlik sekt\u00f6rler i\u00e7in farkl\u0131 h\u00fck\u00fcmler d\u00fczenleme yetkisinin kald\u0131r\u0131lm\u0131\u015f olmas\u0131d\u0131r. Bununla birlikte, daha \u00f6nce a\u00e7\u0131k\u00e7a mevsimlik maddeye dayanan \u00f6zel toplu s\u00f6zle\u015fme d\u00fczenlemelerinin y\u00fcr\u00fcrl\u00fckte kalabilmesini sa\u011flamak amac\u0131yla bir muafiyet h\u00fckm\u00fc getirilmi\u015ftir:<\/p>\n\n\n\n<p>Sapma g\u00f6steren toplu s\u00f6zle\u015fme fesih h\u00fck\u00fcmleri, ABGB Madde 1159 (2) (\u00f6nceki versiyonda) (ABGB Madde 1159 (3a)) uyar\u0131nca 1 Ocak 2018 ile 1 \u015eubat 2025 aras\u0131ndaki d\u00f6nemde akdedilmi\u015f ve ilan edilmi\u015fse ge\u00e7erlili\u011fini korur. Buna g\u00f6re, toplu s\u00f6zle\u015fmenin taraflar\u0131, yukar\u0131da belirtilen zaman aral\u0131\u011f\u0131 i\u00e7inde aktif olarak yeni bir s\u00f6zle\u015fme (art\u0131 yay\u0131n) yapmal\u0131d\u0131r.<\/p>\n\n\n\n<p>Tersine bu, bir yandan 1 Ocak 2018'den \u00f6nce zaten var olan bir toplu s\u00f6zle\u015fme fesih h\u00fckm\u00fcn\u00fc s\u00fcrd\u00fcrmenin yeterli olmad\u0131\u011f\u0131 anlam\u0131na gelmektedir. \u00d6te yandan, 1 \u015eubat 2025 tarihinden sonra imzalanm\u0131\u015f veya imzalanacak olan toplu s\u00f6zle\u015fmeler, geriye d\u00f6n\u00fck olarak y\u00fcr\u00fcrl\u00fc\u011fe girseler dahi, 1 Ocak 2026 tarihinden itibaren ABGB Madde 1159'un fesih h\u00fckm\u00fcnden art\u0131k sapamazlar.<\/p>\n\n\n\n<p><strong>Pratik oryantasyon k\u0131lavuzu<\/strong>Tasar\u0131ya ili\u015fkin a\u00e7\u0131klay\u0131c\u0131 notlarda, farkl\u0131 fesih h\u00fck\u00fcmlerinin uygulanmaya devam etmesi i\u00e7in gereken \u015fartlar\u0131 kar\u015f\u0131layan toplu s\u00f6zle\u015fmeler listelenmektedir:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Tar\u0131msal hizmet sekt\u00f6r\u00fcnde KV \u00e7al\u0131\u015fanlar\u0131,<\/li>\n\n\n\n<li>\u0130n\u015faat sekt\u00f6r\u00fc ve yap\u0131 ticareti,<\/li>\n\n\n\n<li>KV in\u015faat ticaret,<\/li>\n\n\n\n<li>G\u00fcvenlik sekt\u00f6r\u00fcnde KV g\u00fcvenlik g\u00f6revlileri,<\/li>\n\n\n\n<li>KV zemin d\u00f6\u015feme ticareti,<\/li>\n\n\n\n<li>KV kuyu ustas\u0131, temel m\u00fchendisli\u011fi ve derin sondaj y\u00fcklenicisi,<\/li>\n\n\n\n<li>KV \u00e7at\u0131 ticareti,<\/li>\n\n\n\n<li>An\u0131tlar\u0131n, cephelerin ve binalar\u0131n kombine temizli\u011fi, di\u011fer temizlik hizmetleri ve kat hizmetleri,<\/li>\n\n\n\n<li>KV Eisen- und Metallverarbeitendes Gewerbe kalayc\u0131l\u0131k (tesisat\u00e7\u0131lar ve bak\u0131rc\u0131lar) meslekleri i\u00e7in,<\/li>\n\n\n\n<li>KV Ticari ormanc\u0131l\u0131k \u015firketleri,<\/li>\n\n\n\n<li>KV camc\u0131 ticareti,<\/li>\n\n\n\n<li>KV ticari mezarl\u0131k bah\u00e7e \u015firketleri,<\/li>\n\n\n\n<li>KV Ticari bah\u00e7e ve peyzaj \u015firketleri,<\/li>\n\n\n\n<li>KV Hafner-, Platten- und Fliesenlegergewerbe und Keramikergewerbe,<\/li>\n\n\n\n<li>KV ah\u015fap in\u015faat ustas\u0131,<\/li>\n\n\n\n<li>KV boyac\u0131lar\u0131, vernik\u00e7ileri ve tabelac\u0131lar\u0131,<\/li>\n\n\n\n<li>KV asfaltlama ticaret,<\/li>\n\n\n\n<li>Baca temizleyicileri i\u00e7in ek s\u00f6zle\u015fme,<\/li>\n\n\n\n<li>KV Ha\u015fere Kontrol,<\/li>\n\n\n\n<li>KV ta\u015f i\u015f\u00e7ileri ticareti,<\/li>\n\n\n\n<li>KV D\u00f6\u015femeci Ticaret,<\/li>\n\n\n\n<li>KV Holz- und kunstoffverarbeitendes Gewerbe marangozlar ve ah\u015fap tasar\u0131mc\u0131lar\u0131 i\u00e7in ge\u00e7erli versiyonda,<\/li>\n\n\n\n<li>KV \u00d6zel otob\u00fcs \u015firketleri,<\/li>\n\n\n\n<li>CT i\u00e7 navigasyon,<\/li>\n\n\n\n<li>KV teleferikleri,<\/li>\n\n\n\n<li>CT y\u00fck ta\u015f\u0131mac\u0131l\u0131\u011f\u0131 end\u00fcstrisi,<\/li>\n\n\n\n<li>CT k\u00fc\u00e7\u00fck nakliye end\u00fcstrisi,<\/li>\n\n\n\n<li>KV ta\u015f ve seramik sanayi,<\/li>\n\n\n\n<li>KV cam i\u015fleme ve i\u015fleme, d\u00fcz cam ta\u015flama.<\/li>\n<\/ul>\n\n\n\n<p><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">G\u00fcncelleme 01.08.2024<\/h3>\n\n\n\n<p>Anayasa Mahkemesi konuyla ilgili karar\u0131n\u0131 vermi\u015ftir: Y\u00fcksek yarg\u0131\u00e7lar, yasal i\u015f\u00e7i \u00e7\u0131karma d\u00fczenlemesinin anayasaya uygun oldu\u011funa ve bu nedenle tam olarak y\u00fcr\u00fcrl\u00fckte kald\u0131\u011f\u0131na karar vermi\u015ftir (Anayasa Mahkemesi 25 Haziran 2024, G-29\/2024). Anayasa Mahkemesi, toplu i\u015f s\u00f6zle\u015fmesi taraflar\u0131n\u0131n a\u011f\u0131rl\u0131kl\u0131 olarak mevsimlik faaliyetlerin y\u00fcr\u00fct\u00fcld\u00fc\u011f\u00fc sekt\u00f6rlerde daha k\u0131sa ihbar s\u00fcrelerine izin vermesine olanak tan\u0131yan mevsimlik ayr\u0131cal\u0131\u011f\u0131n yasall\u0131k ilkesine veya e\u015fitlik ilkesine ayk\u0131r\u0131 olmad\u0131\u011f\u0131n\u0131 d\u00fc\u015f\u00fcnmektedir.<\/p>\n\n\n\n<p>Bununla birlikte, k\u0131salt\u0131lm\u0131\u015f ihbar s\u00fcresinin uygulanabilirli\u011fini gerektiren a\u011f\u0131rl\u0131kl\u0131 olarak mevsimlik bir sekt\u00f6r olarak s\u0131n\u0131fland\u0131rmaya ili\u015fkin ispat y\u00fck\u00fcn\u00fcn kime ait oldu\u011fu hala belirsiz oldu\u011fundan, otel ve yiyecek i\u00e7ecek sekt\u00f6r\u00fcnde i\u015f ili\u015fkilerinin planl\u0131 bir \u015fekilde sona erdirilmesi durumunda \u201edostane feshe ge\u00e7ilmesi\u201c tavsiye edilmelidir. \u00c7al\u0131\u015fan\u0131n r\u0131zas\u0131n\u0131n olmamas\u0131 nedeniyle bu m\u00fcmk\u00fcn de\u011filse, \u00f6nlem olarak yasal ihbar s\u00fcresi (planlanan fesih tarihinde) uygulanmal\u0131d\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Durum Nisan 2024<\/h3>\n\n\n\n<p>Daha \u00f6nce de bildirildi\u011fi \u00fczere, 1 Ekim 2021 tarihinden itibaren, mavi yakal\u0131 \u00e7al\u0131\u015fanlar i\u00e7in beyaz yakal\u0131 \u00e7al\u0131\u015fanlarla ayn\u0131 yasal ihbar s\u00fcreleri ve bildirim s\u00fcreleri, yani hizmet s\u00fcresine ba\u011fl\u0131 olarak alt\u0131 hafta ila be\u015f ay aras\u0131nda ge\u00e7erlidir. \u0130\u015f ili\u015fkisi \u00fc\u00e7 ayl\u0131k d\u00f6nemin sonunda sona ermelidir ya da - toplu i\u015f s\u00f6zle\u015fmesi, i\u015f s\u00f6zle\u015fmesi ya da bir i\u015f s\u00f6zle\u015fmesinde \u00f6ng\u00f6r\u00fclm\u00fc\u015fse - ay\u0131n 15\u201einde ya da son g\u00fcn\u00fcnde de sona erebilir. Bu h\u00fck\u00fcm, \u00f6zellikle otel ve yiyecek i\u00e7ecek sekt\u00f6r\u00fcnde y\u0131llarca belirsizli\u011fe neden olmu\u015ftur. Y\u00fcksek Mahkeme taraf\u0131ndan verilen iki karar, Y\u00fcksek Mahkeme yarg\u0131\u00e7lar\u0131n\u0131n t\u00fcm \u00e7abalar\u0131na ra\u011fmen hen\u00fcz bir a\u00e7\u0131kl\u0131k getirmemi\u015ftir.<\/p>\n\n\n\n<p>Ancak \u015fimdi yeni geli\u015fmeler var: T\u00fcrkiye'de <strong>Y\u00fcksek Mahkeme ABGB'nin 1159. maddesi h\u00fckm\u00fcn\u00fc anayasaya ayk\u0131r\u0131 buldu<\/strong> ve bu nedenle iptali i\u00e7in Anayasa Mahkemesi'ne ba\u015fvuruda bulunmu\u015ftur. Y\u00fcksek Mahkeme'nin endi\u015feleri, mevcut yasal d\u00fczenlemenin hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc ve e\u015fitlik ilkesine ayk\u0131r\u0131 oldu\u011fu ger\u00e7e\u011fine dayanmaktad\u0131r.<\/p>\n\n\n\n<p>Bu durum, insan kaynaklar\u0131nda operasyonel uygulamalara y\u00f6nelik zorluklar\u0131n alt\u0131n\u0131 \u00e7izmektedir. Bu durumdan sadece otelcilik ve yiyecek-i\u00e7ecek sekt\u00f6r\u00fc de\u011fil, di\u011fer bir\u00e7ok sekt\u00f6r de etkilenmektedir. Bu durum, toplu i\u015f s\u00f6zle\u015fmesi taraflar\u0131n\u0131n mevsimlik ayr\u0131cal\u0131\u011f\u0131n uygulanmas\u0131 konusunda halihaz\u0131rda mutab\u0131k kald\u0131\u011f\u0131 sekt\u00f6rleri (in\u015faat, in\u015faat sekt\u00f6r\u00fc, e\u015fya ta\u015f\u0131mac\u0131l\u0131\u011f\u0131, tesisat\u00e7\u0131lar vb.).<\/p>\n\n\n\n<p>Anayasa Mahkemesi'nin nihai karar\u0131na ba\u011fl\u0131 olarak, gelecek i\u00e7in \u00e7e\u015fitli senaryolar d\u00fc\u015f\u00fcn\u00fclebilir:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>ABGB Madde 1159'un t\u00fcm fesih h\u00fckm\u00fcn\u00fcn iptali<\/strong>: T\u00fcm sekt\u00f6rler eski yasal duruma geri d\u00f6nme tehdidi alt\u0131ndad\u0131r. Bu, 14 g\u00fcnl\u00fck yasal ihbar s\u00fcresinin \u00e7al\u0131\u015fanlar i\u00e7in (hem \u015firket hem de \u00e7al\u0131\u015fan taraf\u0131nda) bir kez daha ge\u00e7erli olaca\u011f\u0131 anlam\u0131na gelecektir. Bu durumda, yasa koyucu muhtemelen yeni bir d\u00fczenleme ile h\u0131zl\u0131 bir \u015fekilde tepki vermek zorunda kalacakt\u0131r.<\/li>\n\n\n\n<li><strong>ABGB \u00a7 1159'da yer alan mevsimsel ayr\u0131cal\u0131\u011f\u0131n (sadece) iptali<\/strong>Bu durum, mavi yakal\u0131 i\u015f\u00e7ilerin i\u015ften \u00e7\u0131kar\u0131lmalar\u0131 i\u00e7in t\u00fcm sekt\u00f6rlerdeki beyaz yakal\u0131 i\u015f\u00e7ilerle ayn\u0131 yasal durumu getirecektir. Bu durumda toplu s\u00f6zle\u015fmelerde i\u015f\u00e7iler aleyhine de\u011fi\u015fiklik yap\u0131lmas\u0131na yasalara k\u0131yasla art\u0131k izin verilmeyecektir (i\u015fverenler i\u00e7in fesih tarihi olarak ay\u0131n 15'i ve son g\u00fcn\u00fcn\u00fcn belirlenmesi hari\u00e7). Toplu s\u00f6zle\u015fmenin taraflar\u0131n\u0131n mevsimlik sekt\u00f6rler i\u00e7in farkl\u0131 fesih d\u00fczenlemeleri belirleme yetkisi de\u011fi\u015ftirilmeksizin kald\u0131r\u0131lacak ve bu da buna dayal\u0131 t\u00fcm toplu s\u00f6zle\u015fme d\u00fczenlemelerini (\u00f6rne\u011fin in\u015faat sekt\u00f6r\u00fc, e\u015fya ta\u015f\u0131ma sekt\u00f6r\u00fc, tesisat\u00e7\u0131lar vb.) etkisiz hale getirecektir.<\/li>\n\n\n\n<li><strong>Ba\u015fvurunun Anayasa Mahkemesi taraf\u0131ndan reddedilmesi<\/strong>Bu durum, mevsimsel ayr\u0131cal\u0131k da dahil olmak \u00fczere ABGB B\u00f6l\u00fcm 1159\u201eun uygulanmas\u0131na devam edilmesi sonucunu do\u011furacakt\u0131r. Bunun ge\u00e7erli oldu\u011fu t\u00fcm sekt\u00f6rler rahat bir nefes alabilir. Mevsimsel ayr\u0131cal\u0131\u011f\u0131n uygulanabilirli\u011finin tart\u0131\u015fmal\u0131 oldu\u011fu sekt\u00f6rler i\u00e7in (\u00f6zellikle otel ve yiyecek i\u00e7ecek sekt\u00f6r\u00fc i\u00e7in) ise bu, i\u015f\u00e7ilerin i\u015ften \u00e7\u0131kar\u0131lmas\u0131na ili\u015fkin yasal belirsizli\u011fin \u201cyar\u0131ndan sonraki g\u00fcne\" kadar devam etmesi anlam\u0131na gelecektir.<\/li>\n<\/ol>\n\n\n\n<p>Uzmanlar Anayasa Mahkemesi'nin 2024 sonbahar\u0131nda bir karar vermesini bekliyor.<\/p>\n\n\n\n<p><strong>Bu arada, bir \u00e7al\u0131\u015fan\u0131n i\u015f akdinin feshi beklemedeyse, a\u015fa\u011f\u0131dakilerin yap\u0131lmas\u0131 tavsiye edilir:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Mevsimlik ayr\u0131cal\u0131\u011f\u0131n toplu s\u00f6zle\u015fmenin taraflar\u0131nca teyit edildi\u011fi sekt\u00f6rlerde (\u00f6rne\u011fin in\u015faat sekt\u00f6r\u00fc, e\u015fya ta\u015f\u0131ma sekt\u00f6r\u00fc, tesisat\u00e7\u0131lar vb.), i\u015fverenler Anayasa Mahkemesi'nin karar\u0131na kadar toplu s\u00f6zle\u015fme iptal d\u00fczenlemelerini b\u00fcy\u00fck bir risk olmadan uygulayabilirler. Anayasa Mahkemesi'nin karar\u0131n\u0131n - i\u00e7eri\u011fi ne olursa olsun - geriye d\u00f6n\u00fck olarak uygulanmas\u0131 gerekece\u011fi d\u00fc\u015f\u00fcn\u00fclmemektedir.<\/li>\n\n\n\n<li>Mevsimsel ayr\u0131cal\u0131\u011f\u0131n uygulanabilirli\u011finin tart\u0131\u015fmal\u0131 oldu\u011fu sekt\u00f6rlerde (\u00f6zellikle otel ve yiyecek-i\u00e7ecek sekt\u00f6r\u00fcnde), kar\u015f\u0131l\u0131kl\u0131 mutab\u0131k kal\u0131nan iptallere ula\u015fmaya \u00e7al\u0131\u015f\u0131lmal\u0131d\u0131r. \u00c7al\u0131\u015fan\u0131n r\u0131zas\u0131n\u0131n olmamas\u0131 nedeniyle m\u00fcnferit durumlarda bu m\u00fcmk\u00fcn de\u011filse, bir sonraki bildirime kadar yasal olarak izin verilen bir
