B\u00f6yle bir istisnai durum yoksa, AMS yard\u0131m\u0131 alman\u0131n yan\u0131 s\u0131ra k\u00fc\u00e7\u00fck bir miktar para kazanma se\u00e7ene\u011fi 1 Ocak 2026'dan itibaren art\u0131k ge\u00e7erli olmayacakt\u0131r.<\/p>\n\n\n\n<p>Prensip olarak, i\u015fsizlik paras\u0131 veya i\u015fsizlik yard\u0131m\u0131 almak i\u00e7in gereken \u015fartlar\u0131 yerine getirmek i\u015fsiz ki\u015filerin sorumlulu\u011fundad\u0131r. Ancak \u015firketler a\u00e7\u0131s\u0131ndan bak\u0131ld\u0131\u011f\u0131nda, etkilenen gruplar\u0131n (i\u015fe yeni girenler ve mevcut \u00e7al\u0131\u015fanlar) AlVG Madde 12 paragraf 2'deki yeni ek kazan\u00e7 k\u0131s\u0131tlamas\u0131 hakk\u0131nda proaktif olarak bilgilendirilmesi mant\u0131kl\u0131d\u0131r.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ek kazan\u00e7lara ili\u015fkin yeni yasa\u011f\u0131n istisnalar\u0131<\/h3>\n\n\n\n<p>Zaman s\u0131n\u0131r\u0131 olmayan istisnai durumlar ile zaman s\u0131n\u0131r\u0131 olanlar aras\u0131nda bir ayr\u0131m yap\u0131lmal\u0131d\u0131r. A\u015fa\u011f\u0131daki d\u00fczenlemeler hem i\u015fsizlik paras\u0131 hem de i\u015fsizlik yard\u0131m\u0131 i\u00e7in ge\u00e7erlidir.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Marjinal istihdam\u0131n s\u0131n\u0131rs\u0131z kullan\u0131m\u0131 veya devam\u0131<\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Vaka tak\u0131my\u0131ld\u0131z\u0131 1: <\/strong>Tam sigortal\u0131 istihdam\u0131n yan\u0131 s\u0131ra en az 26 hafta boyunca marjinal istihdamda bulunduysan\u0131z ve tam sigortal\u0131 istihdam sona ererse, i\u015fsizli\u011finiz sona ermeden i\u015fsizlik \u00f6dene\u011fi al\u0131rken marjinal istihdama devam edebilirsiniz. L\u00fctfen dikkat: Marjinal istihdam bir g\u00fcn bile kesintiye u\u011frarsa, istisna ge\u00e7erli de\u011fildir; daha sonra yeniden ba\u015flanmas\u0131 i\u015fsizlik paras\u0131 veya i\u015fsizlik yard\u0131m\u0131 al\u0131nmas\u0131na zarar verecektir.<\/li>\n\n\n\n<li><strong>Vaka k\u00fcmesi 2 (uzun s\u00fcreli i\u015fsizlik): <\/strong>En az 365 g\u00fcn s\u00fcreyle i\u015fsizlik \u00f6dene\u011fi veya i\u015fsizlik yard\u0131m\u0131 alm\u0131\u015f olan ki\u015filer, ayn\u0131 zamanda a\u015fa\u011f\u0131daki ko\u015fullara da sahiplerse, s\u0131n\u0131rs\u0131z bir s\u00fcre boyunca marjinal olarak \u00e7al\u0131\u015fabilirler<br>* 50 ya\u015f\u0131na ula\u015fm\u0131\u015f olmak veya<br>* Yararl\u0131 bir \u015fekilde engelli iseniz veya<br>* Engelli kart\u0131m var.<br>\u0130\u015fsizlikte 62 g\u00fcne kadar olan kesintiler zarars\u0131zd\u0131r. Bu, deneme s\u00fcresi i\u00e7inde sona eren i\u015f veya istihdam giri\u015fimleri nedeniyle \u201euzun s\u00fcreli i\u015fsiz\u201c stat\u00fcs\u00fcn\u00fcn kaybedilmedi\u011fi anlam\u0131na gelir (bu durumda 365 g\u00fcnl\u00fck say\u0131m yeniden ba\u015flamaz).<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\">Ge\u00e7ici istihdam veya marjinal istihdam\u0131n devam\u0131<\/h4>\n\n\n\n<ol class=\"wp-block-list\">\n<li><strong>Vaka k\u00fcmesi 3 (ek gereklilikler olmaks\u0131z\u0131n uzun s\u00fcreli i\u015fsizlik): <\/strong>En az 365 g\u00fcn yard\u0131m alm\u0131\u015f olan ve 2. durum k\u00fcmesindeki ek ko\u015fullardan hi\u00e7birini yerine getirmeyen uzun s\u00fcreli i\u015fsizler, en fazla 26 hafta olmak \u00fczere marjinal olarak \u00e7al\u0131\u015fabilirler. \u0130\u015fe ba\u015flama ya da hastal\u0131k nedeniyle 62 g\u00fcne kadar olan kesintiler, gerekli \u201euzun s\u00fcreli i\u015fsizli\u011fi\u201c kesintiye u\u011fratmaz.<\/li>\n\n\n\n<li><strong>Vaka k\u00fcmesi 4 (hastal\u0131k yard\u0131m\u0131\/rehabilitasyon\/yeniden e\u011fitim \u00f6dene\u011fi al\u0131nmas\u0131):<\/strong> En az 52 hafta boyunca hastal\u0131k paras\u0131, rehabilitasyon paras\u0131 ya da yeniden e\u011fitim \u00f6dene\u011fi alm\u0131\u015f olan i\u015fsizlerin de sadece s\u0131n\u0131rl\u0131 bir s\u00fcre i\u00e7in -en fazla 26 hafta- marjinal i\u015flerde \u00e7al\u0131\u015fmalar\u0131na izin verilmektedir.<\/li>\n\n\n\n<li><strong>Vaka k\u00fcmesi 5 (e\u011fitim\/yeniden e\u011fitim): <\/strong>\u0130\u015fsizlik paras\u0131 veya i\u015fsizlik yard\u0131m\u0131 al\u0131rken AMS ad\u0131na en az d\u00f6rt ay s\u00fcren ve haftada en az 25 saati kapsayan yeniden e\u011fitim veya ileri e\u011fitimi tamamlayan ki\u015filerin de marjinal olarak istihdam edilmeye devam etmelerine izin verilmelidir (20 Kas\u0131m 2025 tarihli Ulusal Konsey giri\u015fim \u00f6nergesi).<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\">Halihaz\u0131rda devam eden marjinal istihdam i\u00e7in ge\u00e7i\u015f vakalar\u0131 (1 Ocak 2026'dan \u00f6nce ba\u015flam\u0131\u015f):<\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A\u00e7\u0131k u\u00e7lu istisnalar (durum 1 ve 2): Marjinal istihdam, 1 Ocak 2026'dan itibaren i\u015fsizlik paras\u0131 veya i\u015fsizlik yard\u0131m\u0131 ile birlikte de\u011fi\u015fmeden devam edebilir.<\/li>\n\n\n\n<li>Ge\u00e7ici istisnalar (durum 3 ve 4): Yard\u0131m almaya devam edebilmek i\u00e7in marjinal istihdam\u0131n en ge\u00e7 30 Haziran 2026 tarihine kadar sona erdirilmesi gerekmektedir.<\/li>\n\n\n\n<li>Durum 5: E\u011fitim program\u0131n\u0131n kalan s\u00fcresi i\u00e7in ge\u00e7i\u015f durumlar\u0131nda da kullan\u0131labilir.<\/li>\n\n\n\n<li>\u0130stisna yok: Herhangi bir istisna kapsam\u0131na girmeyen marjinal istihdam edilen ki\u015filer, marjinal istihdamlar\u0131n\u0131 en ge\u00e7 31 Ocak 2026 tarihine kadar sona erdirmelidir (\u201etolerans ay\u0131\u201c). Aksi takdirde i\u015fsizlik paras\u0131 ya da i\u015fsizlik yard\u0131m\u0131 alma haklar\u0131 sona erer.<\/li>\n\n\n\n<li>\u00d6nemli: 1 Ocak 2026\u201edan itibaren, yeni marjinal istihdama yaln\u0131zca yeni h\u00fck\u00fcmler uyar\u0131nca izin verilmektedir - bunun i\u00e7in bir \u201ctolerans ay\u0131\" yoktur.<\/li>\n<\/ul>\n\n\n\n<p>Marjinal ek kazan\u00e7 olas\u0131l\u0131\u011f\u0131na ili\u015fkin yasal k\u0131s\u0131tlama, ar\u0131zi istihdam i\u00e7in de ge\u00e7erlidir. Herhangi bir istisna yoksa, i\u015fsizlik paras\u0131 ya da i\u015fsizlik yard\u0131m\u0131 t\u00fcm ay boyunca de\u011fil, sadece marjinal istihdam\u0131n oldu\u011fu g\u00fcnler i\u00e7in kesilir. Marjinal istihdam e\u015fi\u011fi a\u015f\u0131l\u0131rsa, sonu\u00e7lar daha kat\u0131d\u0131r: kazan\u0131lan gelir, kalan ayl\u0131k AMS yard\u0131mlar\u0131ndan mahsup edilir. Her durumda, \u00e7al\u0131\u015fanlar \u00e7al\u0131\u015ft\u0131klar\u0131 her g\u00fcn\u00fc AMS'ye bildirmek ve ertesi g\u00fcn tekrar i\u015fsiz olarak kay\u0131t yapt\u0131rmak
