{"id":1078,"date":"2026-04-01T09:17:29","date_gmt":"2026-04-01T07:17:29","guid":{"rendered":"https:\/\/www.moore-salzburg.at\/?p=1078"},"modified":"2026-04-01T09:17:31","modified_gmt":"2026-04-01T07:17:31","slug":"verschwiegener-pensionsbezug","status":"publish","type":"post","link":"https:\/\/www.moore-salzburg.at\/nl\/verschwiegener-pensionsbezug\/","title":{"rendered":"Geheimhouding van pensioenuitkeringen"},"content":{"rendered":"<h1 class=\"wp-block-heading\">Indien de pensioenuitstelling \u201ekantelt\u201c<\/h1>\n\n\n\n<p>Wie de wettelijke pensioenleeftijd heeft bereikt (mannen vanaf 65 jaar, vrouwen \u2013 afhankelijk van het geboortejaar \u2013 tussen 60 en 65 jaar) en zijn pensioeningang bewust uitstelt, kan volledig verzekerd blijven werken. In dit geval is er sprake van een bijdragevoordeel: de premies voor de pensioenverzekering worden gehalveerd conform \u00a7 51 lid 7 ASVG. Maar wat als er sprake was van een verzwegen pensioenuitkering? <\/p>\n\n\n\n<p>In de afgelopen maanden kwamen er namelijk gevallen voor waarbij dit pensioenuitstel achteraf problematisch werd voor werkgevers. Typisch daarbij is het volgende scenario: een werknemer of werknemer legt eerst het bewijs voor van een uitgestelde pensioenaanvraag, maar besluit later (bijvoorbeeld om financi\u00eble redenen) toch om het pensioen op te nemen, zonder het bedrijf hiervan op de hoogte te stellen.<\/p>\n\n\n\n<p>In de salarisadministratie worden de verlaagde pensioenverzekeringsbijdragen nog steeds in overweging genomen totdat de zorgverzekeringsmaatschappij de werkelijke pensioenuitkering vaststelt \u2013 vaak pas maanden later. Zo'n verzwegen pensioenuitkering heeft dus als gevolg: Een nabetaalde bijdrage met een verzoek om de maandelijkse basis voor bijdragen te corrigeren en de ontbrekende werknemers- en werkgeversaandelen na te betalen.<\/p>\n\n\n\n<p>Hiermee staan werkgevers regelmatig voor twee centrale vragen:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Hoe kunnen dergelijke gevallen worden voorkomen?<\/li>\n\n\n\n<li>Kan de onderneming de achterstallige werknemersbijdragen van de betreffende persoon terugvorderen?<\/li>\n<\/ol>\n\n\n\n<h4 class=\"wp-block-heading\">Hoe werkgevers risico's kunnen voorkomen<\/h4>\n\n\n\n<p>Indien de gehalveerde pensioenverzekeringspremies worden toegepast, is het raadzaam om gestructureerd te werk te gaan:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Medewerkers en medewerksters die de pensioenleeftijd hebben bereikt, dienen een recent bewijs van niet-ontvangst van het pensioen te overleggen (verklaring van de pensioenverzekeringsinstantie).<\/li>\n\n\n\n<li>Daarnaast dient in een schriftelijk document te worden vastgelegd:\n<ul class=\"wp-block-list\">\n<li>dat de pensionering onverwijld dient te worden gemeld, en<\/li>\n\n\n\n<li>dat in dat geval naplichten van de pensioenverzekeringsbijdragen kunnen ontstaan.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Voor de zekerheid dient deze controle jaarlijks te worden herhaald \u2013 inclusief een nieuwe bevestiging van de pensioenverzekeraar dat er nog steeds geen sprake is van pensioenontvangst.<\/li>\n<\/ul>\n\n\n\n<p>Op deze manier kunnen bedrijven aantonen dat zij aan hun zorgplicht hebben voldaan en onnodige risico's vermijden. <\/p>\n\n\n\n<p>  <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Kunnen achterstallige werknemersaandelen worden teruggevorderd?<\/h4>\n\n\n\n<p>Ondanks alle voorzorgsmaatregelen toch sprake is van een \u201everkeerde pensioenuitstelling\u201c, rijst de vraag naar een mogelijk regres. In beginsel geldt:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Indien de betreffende persoon zijn meldingsplicht heeft geschonden, terwijl de werkgever geen schuld treft, kunnen de met terugwerkende kracht betaalde werknemersbijdragen als schadevergoeding worden geclaimd.<\/li>\n\n\n\n<li>Indien het bedrijf voorafgaand duidelijk en schriftelijk heeft gewezen op het risico van een nawijzing van sociale premies bij pensionering, kan de betreffende persoon zich niet beroepen op \u201ete goeder trouw verbruik\u201c van de verhoogde netto-uitkering.<\/li>\n<\/ul>\n\n\n\n<p>In de praktijk betekent dit: hoe duidelijker bedrijven documenteren, hoe beter een regres kan worden beargumenteerd.<\/p>\n\n\n\n<p><strong>Conclusie<\/strong>Juist in de fase rond de pensioenleeftijd zijn duidelijke afspraken en regelmatige updates essentieel om latere verrassingen te voorkomen.
