{"id":1177,"date":"2026-08-04T12:39:15","date_gmt":"2026-08-04T10:39:15","guid":{"rendered":"https:\/\/www.moore-salzburg.at\/?p=1177"},"modified":"2026-08-04T12:43:11","modified_gmt":"2026-08-04T10:43:11","slug":"steuerfreie-mitarbeiterinnenpraemien-2026","status":"publish","type":"post","link":"https:\/\/www.moore-salzburg.at\/en\/steuerfreie-mitarbeiterinnenpraemien-2026\/","title":{"rendered":"Tax-free employee bonus 2026"},"content":{"rendered":"<h2 class=\"wp-block-heading\">Tax exemption of the employee bonus 2026 only under strict conditions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">From 1 July 2026, it is possible to pay out employee bonuses of up to EUR 500.00 per employee exempt from income tax. The legal basis for this is Section 124b item 478 lit f of the Austrian Income Tax Act (EStG). However, this tax relief does not apply generally, but only if the employee bonus is provided for in a corresponding wage-setting regulation.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">What fundamentals are required for 2026<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The tax exemption only applies to employee bonuses that are provided for in one of the following wage-setting regulations:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>under the collective agreement<\/strong><\/li>\n\n\n\n<li><strong>in a company agreement<\/strong> between employer and works council if it is concluded on the basis of an explicit collective agreement authorisation<\/li>\n\n\n\n<li><strong>in a company agreement<\/strong>between employer and works council, where there is no collective bargaining agent on the employer side and the works agreement is co-signed by the competent trade union<\/li>\n\n\n\n<li><strong>in workplaces without a works council in an agreement for all employees<\/strong>, if there is explicit authorisation in the collective agreement for plant-level regulation or if there is no party on the employer side capable of concluding a collective agreement<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">This means that the regulatory monopoly for tax-free employee bonuses in 2026 essentially lies with the collective bargaining parties. This means that the collective agreement must either regulate the employee bonus itself or provide for an opening clause for a company-level agreement. The options involving works council agreements or agreements in companies without a works council are only possible in certain constellations.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">What this means for businesses<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">As soon as a collective bargaining-capable body exists, a tax-free employee bonus in 2026 strictly requires a collective agreement provision. This affects, for example, businesses that are members of the Austrian Federal Economic Chamber, another collective bargaining-capable chamber, or a collective bargaining-capable voluntary employers' association.<br>Even if there is no collective agreement despite the existence of a competent employers' association, a company-level agreement does not constitute a sufficient wage-regulation provision in such cases.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Exemption from income tax only<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The tax relief applies exclusively to income tax. No exemption is provided for other levies. Therefore, the following in particular are not eligible:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Social security<\/li>\n\n\n\n<li>workplace pension<\/li>\n\n\n\n<li>non-wage labour costs such as DB, DZ and KommSt<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">No CBA regulations visible yet<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">As of the current status (early August 2026), there are still no relevant collective agreement regulations or collective agreement opening clauses that enable company-level regulations for tax-free employee bonuses.<br>Given the limited appeal of the scheme, particularly due to the exclusive income tax exemption and the EUR 500.00 ceiling, it currently seems rather doubtful whether there will still be a significant number of collective agreement conclusions in the course of the year.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Conclusion<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\">The tax-free employee bonus for 2026 is possible, but is tied to strict legal requirements. Whether the tax relief can be utilised in a specific case depends largely on whether there is an appropriate collective agreement basis.<br>Therefore, before a planned payout, it should be carefully checked whether the requirements are actually met.
